1. Scope

These General Terms and Conditions (GTC) apply to all deliveries by Unterluggauer & Denker GbR (hereinafter MOKIT) to consumers.
A consumer is any natural person who concludes a legal transaction for purposes that predominantly are not attributable to their commercial or independent professional activity.

2. Contractual Partner

The purchase contract is concluded with Unterluggauer & Denker GbR, Owners: Benjamin Unterluggauer & Neele Marie Denker, Wachtelstraße 6, 22305 Hamburg.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.

By clicking the [Buy] button, you submit a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order. The language available for concluding the contract is German.

If you have chosen PayPal as the payment method, the contract is concluded at the moment you confirm the payment instruction to PayPal.

You can view the GTC at any time on this page. Your past orders are no longer accessible online for security reasons.

4. Delivery Conditions

We deliver by shipping. Self-collection of goods in Hamburg is possible by arrangement.

5. Payment

The following payment methods are available in our shop:

Credit Card

Your credit card is charged at the time you complete the order.

PayPal

You pay the invoice amount via the online provider PayPal. You must generally be registered there or register first, log in with your credentials, and confirm the payment instruction to us. Further details are provided during the ordering process.

Advance Payment (Bank Transfer)

You will be asked to transfer the invoice amount to the seller’s bank account.

6. Right of Withdrawal

Consumers have the statutory right of withdrawal as described in the withdrawal policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Retention of Title

The goods remain our property until full payment is received.

For entrepreneurs, the following additionally applies: We retain ownership of the goods until all claims arising from an ongoing business relationship have been fully settled. You may resell the goods subject to retention of title in the ordinary course of business; you hereby assign to us in advance all claims arising from such resale—regardless of any processing or combination of the goods with a new item—up to the amount of the invoice value, and we accept this assignment. You remain authorized to collect the claims, but we may also collect them ourselves if you fail to meet your payment obligations.

8. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to make such a complaint or contact us has no consequences for your statutory rights and their enforcement, especially your warranty rights. However, you help us assert our own claims against the carrier or the transport insurance.

9. Warranty and Guarantees

Statutory liability for defects applies. Information on any additional guarantees and their precise conditions can be found with the product or on special information pages in the shop.

10. Images

We point out production-related and natural characteristics of the products. As a result, there may be deviations from the images shown in the online shop. These do not constitute a defect.

11. Final Provisions

If you are a merchant as defined by the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our business location.
